Abstract

Mortgage rights are collateral rights over land, including objects that are an integral part of the land, both above and below the ground which are used as collateral for debt repayment. If there is a default between the creditor and the debtor, an auction for the execution of mortgage rights will be carried out which is part of the law enforcement of guarantees as a last resort taken by the creditor in terms of repaying the debt. Execution of the mortgage right if indeed there is no peaceful path to resolve the problem between the creditor and the debtor. The execution of the mortgage right is carried out after the subpoena given is also ignored by the debtor.
