Tanggung Jawab Negara Terhadap Pemenuhan Jaminan Sosial Atas Pemberlakuan Pembatasan Kegiatan Masyarakat Pada Masa Pandemi Covid-19

Abstract

This study conducts a comprehensive analysis of the right to social security in the concept of a state in Indonesia and the state's responsibility for the fulfillment of constitutional social security and the implementation of state responsibility for implementing community activities during the Covid-19 pandemic. The type of this research is legal research through a legal approach and a conceptual approach using primary and secondary legal materials and using various library materials as additional references with analytical descriptive research characteristics. Therefore, the results of this study state that awareness of the importance of the right to social security as a basic need of society must be considered by the state and the state must always be faithful to be present in providing social security for the community as regulated in the constitution. Then, the policy on the implementation of community activities should not derogate the various principle rights of the community so that it can optimize responsibilities. Furthermore, a more responsive legal formulation is needed in the social regulation of life during the Covid-19 pandemic, because the existing regulatory products are no longer relevant to the developing situation.
